“Thank you for booking and/or travelling on a tour with yaro tours Egypt.
(“YTE”). These Terms and Conditions apply to any travel products and/or services you have booked with or purchased from YTE, and govern the contractual relationship between you and YTE concerning any such travel products and/or services (hereinafter, the “Products”). Please read these Terms carefully as by booking any Product with YTE, or by travelling on a YTE tour or Product you acknowledge that you: i) have read and understand these Terms, and ii) indicate your express acceptance of and agree to be bound by these Terms. If you have confirmed a booking on any Products with more than one client named and booked on such booking, you shall be deemed to have accepted these Terms and Conditions (the “Terms”) on behalf of all clients named in the booking (including minors and those under a disability) and travelling on or otherwise participating in any Products (hereinafter “you”, the “Client(s)”), and by such travel or participation all passengers indicate their assent to these Terms. The client who confirmed the booking is deemed to be the designated contact person for all other clients named in such booking. These Terms constitute the entire agreement between the Client and YTE concerning the subject matter hereof and supersede all prior agreements, representations and understandings of the parties, written or oral.
- THE BOOKING CONTRACT
A booking is confirmed and these Terms shall apply when YTE, or an authorized agent acting on YTE’s behalf, has received the applicable deposit from the Client and the Client has received written confirmation from YTE of such booking. The Client confirming the booking must be no less than 18 years of age and agrees to provide full, complete, and accurate information as requested by YTE to confirm such booking.
Any Client confirming a booking on any Products with more than one Client named and booked on such booking represents and warrants to YTE that:
i) they have all requisite consents and authority to make such booking on behalf of all other Clients named on the booking and have communicated all necessary information to the other Clients for them to give free and fully informed authorization to do so.
ii) the information that they are providing regarding all clients is complete and accurate, and they have obtained all necessary consents and permissions to share such information with YTE to complete the booking.
iii) they will inform all other named Clients on the relevant booking of the applicability of these Terms to the booking and the Clients’ relationship with YTE.
At any time before a booking is confirmed, YTE reserves the right to increase or decrease brochure prices of any Products. YTE or their agents reserve the right to decline any booking, at their sole discretion.
- MEDICAL CONDITIONS
All Clients should consult their physician regarding their fitness for travel. YTE encourages all Clients to seek their physician’s advice regarding necessary or advisable vaccinations, medical precautions, or other medical concerns regarding the entirety of the Client’s travel with YTE.
YTE does not provide medical advice. Clients must notify YTE in writing before the due date of their final payment for their booking of any medical conditions, pregnancy, disability, or any other mental and or physical condition which may impact the Client’s fitness to travel, and/or any continuing medical condition. Full disclosure of such information is a condition of traveling on any Product or in any capacity with YTE.
Certain Products may not be suitable for all people due to restrictions posed by limitations in mobility, physical or cognitive disability, pregnancy, or various other physical or mental conditions. It is the Client’s responsibility to assess the risks and requirements of each Product in light of such Client’s limitations, physical and mental fitness and condition, and any medical requirements or issues of such Client.
YTE may refuse to carry pregnant women over 24 weeks or Clients with certain conditions, if suitable accommodation or alternate Products or services cannot be arranged. Certain Tours, as offered by YTE, by its nature involve visiting remote or less developed regions, where medical facilities may not meet the standards of those found in a Client’s home country.
YTE will endeavor to accommodate the special requests of Clients, such as dietary and accommodation requests, but such requests do not form part of these Terms or the contract between Client and YTE, and YTE is not liable for any failure to accommodate or fulfill such requests.
Travel with YTE may involve visiting remote or developing regions, where medical care may not be easily accessible and medical facilities may not meet the standards of those found in your home country. The condition of medical facilities in the countries you may visit on your Tour varies and YTE makes no representations and gives no warranties about the availability or standard of medical facilities in those regions.
- SPECIAL REQUIREMENTS
Any special requirements must be disclosed to the Tour Operator at the time of booking. The Tour Operator will use reasonable efforts to accommodate special requirements or requests but this is not always possible given the nature of the destinations visited and the availability of options outside a planned itinerary. Certain activities may be inaccessible to you if your mobility is limited in any way.
All food allergies and dietary restrictions must be disclosed to the Tour Operator at the time of booking but the Tour Operator cannot guarantee that dietary needs or restrictions can be accommodated. Any special requests or requirements do not form part of these Terms or the contract between you and the Tour Operator and the Tour Operator is not liable for any failure to accommodate or fulfill such requests.
- AGE REQUIREMENTS
Clients aged 18 at the date of travel are deemed to be adults. Anyone under the age of 18 on the date of travel is considered to be a minor. Minors must always be accompanied by an adult. One adult may accompany up to two minors. Unless otherwise indicated in the Tour description or by the Tour Operator, the minimum age for minors traveling on any Tour vary based on the tour style.
All bookings with a minor are subject to review and approval by YTE. If the consent of a parent, guardian or any other person is required by applicable law for any minor to travel, the accompanying adult is responsible for securing all consents, and documentation and ensuring that they and the minor(s) meet all legal requirements to travel, to enter into and depart from applicable countries and regions. The Tour Operator will not be responsible for any fees, damages, or losses incurred as a result of any failure to secure necessary consents, permits, and approvals.
YTE reserves the right to restrict the number of Minor Clients on any given Product where it deems necessary. If the adult accompanying a Minor Client is not the Minor Client’s custodial parent or legal guardian, then a “Parental Consent Guardianship Form” must be signed (along with other documents provided as requested by YTE) by the Minor Client’s parent or legal guardian and must be received by YTE along with or before the final payment made in respect of the Minor Client’s booking.
Each adult on a booking with a minor or minor(s) is jointly and severally responsible for the behavior, wellbeing, supervision, and monitoring of such minor(s), and jointly and severally accepts these Terms for and on behalf of any minor(s) on their booking, including all assumptions of risk and limitations of liability. The Tour Operator does not provide care services for minors and expressly disclaims any responsibility for chaperoning or controlling any minor(s).
- FOREIGN CURRENCY
YTE Products are available for purchase using several global currencies including, but not limited to (Euro (EUR€) or United States Dollar (USD$)). The currency applied to the Client’s booking will be determined by YTE, in consideration of the booking location of the Client. The Client will be advised of the applicable currency before making any payment to YTE.
YTE may provide a feature through which Client (s) may view Payment for various Listings in foreign currencies. You understand and agree that these views of Payment are for informational purposes only and are not the official Payment for the Listings. If you (as a Traveler) request a booking, you will be charged with the amount of Payment in United States dollars (USD$), if your booking is confirmed. The currency in which you will be charged may be determined by YTE based on the payment method you select. If the currency in which you will be charged is different from the currency chosen by YTE to receive payment, YTE will be responsible for the required currency conversion processing, including the costs thereof, which will be calculated based on the most current applicable foreign exchange rate that YTE has uploaded to the Site as of the date and time that your booking is confirmed (the “Applicable Exchange Rate”). You acknowledge that the Applicable Exchange Rate used for currency conversion processing may not be identical to the applicable market rate in effect at the specific time such processing occurs because: (i) although YTE would update the Applicable Exchange Rate regularly, it would not update such rate on a real-time basis; and (ii) the Applicable Exchange Rate may include an incremental cost or margin that is not included in the applicable market rate. For the avoidance of doubt, YTE would retain any profits (and will bear any losses) that result from such currency conversion processing due to changes in the applicable foreign exchange rate.
- PRICES, SURCHARGES AND TAXES
The published price of the Tour and any products or services offered by YTE is subject to change at any time, before or after booking confirmation, up to 30 days before departure. Tours are priced and advertised exclusive of applicable sales taxes. After a confirmation invoice has been issued by YTE, YTE reserves the right to impose surcharges on any products or services booked for reasons arising from increases in transportation costs, fuel costs, dues, taxes, or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airport charges, local operator costs, currency and exchange fluctuations, increases in taxes, or government action which impacts the price of the applicable products or services provided.
Where the increase the original price of the applicable products or services (excluding add-ons, insurance, and taxes), you may choose to either:
(a) cancel the applicable booking without incurring any penalty; or
(b) accept the change of price.
You must notify YTE of your choice within 14 days of receipt of notice of the increase or you will be deemed to have accepted the price change and will be liable for payment of the increase.
From time to time YTE may offer reduced pricing on certain products or services. The reduced pricing applies only to new bookings. Bookings, where payment of at least a deposit has been received by YTE, are not entitled to the reduced pricing.
- VALIDITY
The prices of Products advertised in YTE brochures and on the YTE website are based on costs in effect at the time of printing the brochure or posting to the website. YTE reserves the right to alter the prices of any Product at any time before the receipt of payment in full for such Product. All dates, itineraries, and prices are indicative only and the price quoted at the time of Booking shall be the applicable price, subject to the surcharges that may be levied by these Terms.
Changes, revisions, or other amendments may be made to the particulars contained in any YTE brochure or on the YTE website before a contract is concluded, and such changes, revisions, or amendments shall be incorporated herein as of the date of such amendment.
You acknowledge that you are responsible for keeping up to date on the specific details of your Tour and any other products or services, including, but not limited to checking YTE’s website at least 72 hours before departure as minor changes may have been made after the time of booking.
- DEPOSITS
At the time of booking, you are required to pay at least a deposit of 50% of the tour price, as applicable, per person per Tour is due to YTE.
For certain products or services, the Tour Operator may require you to provide a higher deposit or make full payment at the time of booking. The Tour Operator will advise you of any such requirements before confirmation of the applicable booking.
YTE will collect the deposit and/or the total cost at the time of booking confirmation. The Balance of Payment (defined as the Total Cost minus the deposit) will be payable directly based on the Payment Terms as stated by YTE on the booking page.
The deposit displayed on the booking reference page is generally based on YTE Terms as outlined on the booking reference page. Where applicable, Taxes may be charged in addition to the Tour Cost.
If you cancel your booking, and that cancellation is not a result of nonpayment or any other breach of these Terms, the deposit amount will be held as a “Lifetime Deposit” with YTE, subject to these Terms. Lifetime Deposits have no expiry and may be applied towards payment of a deposit on any other Tour offered by YTE. The Lifetime Deposit is transferable and may be transferred by you to another individual of your choosing by providing notice to the Tour Operator in writing.
For the avoidance of doubt, only the deposit amount will form part of the Lifetime Deposit. The Lifetime Deposit has no cash value. Only one Lifetime Deposit may be applied per person per product booked. A Lifetime Deposit must be applied to a new Tour booking that is of equal or greater value to the canceled Tour for which the Lifetime Deposit was originally received. A Lifetime Deposit may not be applied to the same or similar dates of travel.
- BOOKING REQUIRED DETAILS
In order for us to confirm your booking and/or your travel arrangements, you must provide the information requested by YTE along with Deposit and/or final payment.
Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements.
If you fail to provide all required information prior to the date on which deposit is due, an administrative fee will be charged for any costs incurred by YTE as a result of your failure to provide the required information. If you fail to supply information required by YTE for air tickets, permits, or other inclusions, you will also be liable for any costs, fees or losses including failure to obtain or provide that inclusion. In the event that you fail to supply information required by YTE, YTE also reserves the right to treat your booking (or the relevant component of your booking) as cancelled and levy any cancellation fees deemed reasonable by YTE, in its sole discretion. The information required by YTE will vary by Tour and will be communicated to you or to YTE’s authorized agent during the booking process. YTE will not be held responsible for any fees you incur as a result of errors, omissions, inaccuracies, late, misplaced or otherwise incomplete information you have provided.
10 – ACCEPTANCE OF BOOKING & FINAL PAYMENT
The confirmation sent by YTE will contain details of the final payment required for any booking. Payment of the balance of the price for any products or services booked (excluding custom-tailored products or services) is due two weeks before the arrival date in Egypt included in the applicable booking. A contract will exist between us from the date we issue the confirmation invoice. Please refer to your booking confirmation invoice for details regarding final payments. If full payment is not received by the applicable due date, YTE, at its sole discretion, change the rate for the booking, or treat the booking as canceled and retain the deposit paid on the booking as a cancellation fee. If for any product or service booked, payment terms differ from those outlined in this section, the applicable terms will be communicated to you before booking. They will also be detailed on the relevant invoice.
YTE is not responsible for any charges levied by third parties or financial institutions and payable by you as a result of credit card or other payment transactions and will not refund or return any fees charged by third parties or financial institutions in connection with payments made by you to YTE.
11 – CANCELLATION BY THE CLIENT
Any cancellation of a booking and/or a Product by a Client must be delivered to YTE in writing and be acknowledged by YTE in writing. The applicable cancellation fees shall be determined concerning the date on which the request to cancel is received by YTE, and are expressed hereinafter as a percentage of the total price paid for the canceled Tour, product, or service.
Once you submit your deposit, 25% of the total price is non-refundable.
Cancellation of The Tour Packages:
(a) Cancellation received 150 – 120 days before departure of first product or service in relevant booking: 50% cancellation fee of the total price will be applied by these Terms.
(b) Cancellation received 119 – 90 days before departure of first product or service in relevant booking: 75% cancellation fee of the total price will be applied by these Terms.
(c) Cancellation received 89 – 60 days before departure of first product or service in relevant booking: 90% cancellation fee of the total price will be applied by these Terms.
(d) Cancellation received 59 days before departure of first product or service in relevant booking: 100% cancellation fee of the total price will be applied by these Terms, and no further refund will be payable.
Cancellation of Transfers, Day Trips, Shore Excursions, and other products provided by YTE:
(a) Cancellation 91 days before departure: 25% cancellation fee of the total price will be applied by these Terms.
(b) Cancellation received 90 – 60 days before departure: 50% cancellation fee of the total price will be applied by these Terms.
(c) Cancellation received 59 – 31 days before departure: 75% cancellation fee of the total price will be applied by these Terms.
(d) Cancellation received 30 days before departure: No refund will be payable.
For certain products or services YTE, alternative cancellation terms may apply. YTE will advise you of any such requirements before confirmation of the applicable booking.
12 – CANCELLATION BY YTE
YTE guarantees that all scheduled Tour departures booked and secured with at least one booking secured by a valid deposit has been made on that departure will depart as indicated on the applicable confirmation, subject to reasonably itinerary changes as described in these Terms or good faith health and safety concerns. This guarantee is not applicable in the case of Force Majeure.
YTE will not cancel a booking on any tour Product once confirmed, by these Terms, except for reasons of ‘Force Majeure’, which shall be defined as unusual or unforeseen circumstances outside of the reasonable control of YTE. When a tour is cancelled by YTE before the agreed date of departure for reasons not arising from the fault or negligence of or within the reasonable control of the Client, the Client shall have the choice of:
(a) accepting from YTE a substitute tour Product of equivalent or superior value, where such substitute is reasonably available; or
(b) accepting from YTE a substitute tour of lower value if no tour of equivalent or superior value is reasonably available, and to recover from YTE the difference in price between the price of the tour originally purchased and that of the substitute tour; or
(c) accept from YTE a full refund of all monies paid for the cancelled tour Product(s), or you can transfer amounts paid to alternate departure date.
YTE is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the cancelled booking including visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. YTE reserves the right to issue a full refund instead of the choices above, at its sole discretion. Where a significant element of a Tour as described cannot be provided after departure, YTE will make suitable alternative arrangements where possible. If it is not possible to provide a suitable alternative or if the Client reasonably rejects any suitable alternatives, YTE may provide you with a refund for unused products or services as determined at its discretion.
13 – TRAVEL DOCUMENTS
It is the Client’s responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure, and travel to each country or region. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits, and certificates (including but not limited to vaccination or medical certificates) and insurance policies. You must have a passport that is valid 6 months after the last date of travel with YTE as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas, and permits before the start of the Tour, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by YTE that is a direct result of your failure to secure or have proper travel documentation for themselves and also for all children traveling with such Client. YTE does not provide advice on travel documents and makes no representations or warranties as to the accuracy or completeness of any information provided on visas, vaccinations, climate, clothing, baggage, or special equipment and you agree that YTE is not responsible for any errors or omissions in this information.
Vaccinations: Clients should consult their National Health Service for information in respect of any recommended vaccinations required. It is the Client’s responsibility to check with their doctor to make sure that they have any recommended vaccinations or medication (and its suitability) required for their particular destinations.
Documents: Please note that all travel documents for Products such as vouchers, itineraries, and invoices will be sent electronically, via email to the e-mail address provided on the booking. YTE reserves the right to impose an administration fee on those Clients who wish to receive their travel documents by other means.
Trip Details: The Client acknowledges that due to the changing nature of travel, they are responsible for keeping up to date on the details of their travel, including, but not limited to checking their e-mail at least 72 hours before departure to ensure the Client has the most current Trip Details as minor changes may have been made since the tour documents were originally provided by YTE.
Any information or advice given by YTE regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory, provided as a courtesy to the Client, and YTE is not responsible for any errors or omissions in the information provided, or in the information provided to Clients by third parties such as government or travel authorities.
14 – FLEXIBILITY
You appreciate and acknowledge that the nature of traveling requires flexibility and acknowledges that YTE will permit reasonable alterations to products, services, or itineraries. but it is understood that the route, schedules, accommodations, activities, amenities, and mode of transportation are subject to change without notice due to unforeseeable circumstances or events outside the control of YTE (including but not limited to Force Majeure, illness, mechanical breakdown, flight cancellations, strikes, political events and entry or border difficulties).
15 – UNUSED SERVICES
Neither YTE nor its authorized agents shall offer, pay or issue any reimbursements, discounts, or refunds for missed or unused services which were missed or unused by the Client due to no fault of YTE, its agents, or representatives, which shall include any termination of the Client’s participation in the tour Product due to the Client’s fault, negligence or breach of these Terms.
16 – CHANGES
Changes made by YTE: While YTE will endeavor to operate all Products as advertised, reasonable changes in the itinerary of any Product may be made where deemed necessary or advisable for operational reasons by YTE, in its sole discretion. If YTE makes a Material Change (defined as a change affecting at least one in three full tour days of the itinerary, or which materially affects the character of the Product in its entirety) to any Product, YTE will inform the Client(s) booked on such Product of any Material Change as soon as reasonably possible, provided that there is sufficient time before departure to properly notify all affected Clients. If a Material Change is made more than 14 days before departure, the affected Client may elect to:
a) accept the Material Change and proceed with the amended Cruise Product;
b) book another Product of equivalent or greater value, if available (Client shall be responsible for paying any difference in price between the amended Product and the Product booked in its place);
c) book another Product of a lower value, if available, with a refund payable to the Client for the difference in price; or
d) cancel and receive a full refund of all monies paid in respect of the land-only portion of the applicable Product (and for clarity, this shall not extend to additional Products booked by the same Client which are not subject to any Material Change).
The affected Client must notify YTE of their decision in writing or via their travel agent within 7 days of receiving the notification of alteration, or they shall have been deemed to accept the Material Change and deemed to have agreed to the amended Product itinerary.
If any Material Change arises from reasons of Force Majeure, as hereinafter defined, the Client shall be entitled to recover only the costs of the Product recoverable by YTE.
Once a Product tour has departed, changes to such Product’s itinerary may be necessary or advisable as a result of unforeseen circumstances or other reasons related to effective Product operation, health, safety, Client enjoyment, or Client comfort. YTE will make suitable alternative arrangements, at no extra cost to the Client, for the continuation of the Product tour and will, where appropriate, compensate the Client for the difference between the services to be supplied under the contract and those supplied. If YTE is unable to make arrangements as described above for reasons other than the refusal of the Client to accept such arrangements, YTE will, where appropriate, provide the Client with equivalent transport back to the Client’s place of departure or to another place to which the Client and YTE have mutually agreed. Any such changes are at the discretion of the YTE Tour Leader and any indirect costs incurred as a result will be the responsibility of the Client. The Client acknowledges that they must have reasonable financial resources to cover incidental expenses on every Product on which they travel, whether or not they arise from a change in the itinerary or from the travel itself, and that YTE shall not be liable for any Client’s failure to prepare adequately for their travel and unforeseen circumstances which may arise during such travel.
YTE will not be liable for any indirect and or consequential losses associated with any changes to a Product’s itinerary.
Changes made by the Client: The client may contact YTE directly by telephone, or their booking agent, to correct any errors in the Client’s personal information recorded on their booking. The client is responsible for ensuring that information provided to YTE in making their booking is accurate, up-to-date, and correct. A transfer from one Product tour to another may only be made 2 days or more before departure of the applicable Product, (and more than 7 days before departure for Tour Packages) and such transfer must be approved by YTE. If such a request is accepted by YTE, YTE reserves the right to charge up to the deposit amount of the first booked tour. Any request to transfer received less than 1 day, (3 days for Tour Packages) before departure will not be accepted. In this case, the Client must cancel the Product booking by the cancellation terms herein and create a new booking for any other Products. The Client may only transfer a booking to a departure date in the same calendar year and may not transfer a booking to future calendar years. Any changes to the traveling Client’s name on any Product booking are subject to YTE’s approval and applicable Administrative Fees may apply, which will be payable by the Client.
Where the Client is prevented through reasons completed beyond such Client’s control from proceeding with a Product tour as booked the Client may, if possible, transfer his/her Product booking to a person who satisfies all the conditions applicable to the Product tour, provided that the Client gives notice to YTE of Client’s intention to transfer no less than 7 days before the date when departure is due to take place. Where such a transfer is made, the transferring Client and the transferee Client shall be jointly and severally liable to YTE for payment of the price of the Product (or, if part of the price has been paid, for payment of the balance) and for any additional costs arising from such transfer.
Other Changes: Any changes to a file will depend on availability and will be on a request basis and subject to YTE’s approval. Any extra costs incurred for making the change will be charged to the Client along with an Administrative Fee. No changes are permitted to any booking within 10 days of departure of the first Product to depart under the applicable booking.
17 – ACCEPTANCE OF RISK
THE CLIENT ACKNOWLEDGES THAT THE NATURE OF PRODUCT TOURS MAY INVOLVE A SIGNIFICANT AMOUNT OF RISK TO CLIENTS’ HEALTH AND/OR SAFETY. TO THE FULL EXTENT PERMISSIBLE BY LAW THE CLIENT HEREBY ASSUMES ALL SUCH RISK AND DOES HEREBY RELEASE YTE FROM ALL CLAIMS AND CAUSES OF ACTION ARISING FROM ANY DAMAGES OR INJURIES OR DEATH RESULTING FROM THESE RISKS INHERENT IN TRAVEL, VISITING FOREIGN DESTINATIONS, AND PARTICIPATING IN ADVENTUROUS ACTIVITIES SUCH AS THOSE INCLUDED IN PRODUCT ITINERARIES.
You acknowledge that the degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, carriage by watercraft, participation in “extreme sports” or other high-risk activities, or travel to areas with developing infrastructure. Standards of hygiene, accommodation, and transport in certain areas where Tours take place are often lower than the standards you may reasonably expect in your home country or region. You agree that YTE is not responsible for providing information or guidance concerning local customs, weather conditions, specific safety concerns, physical challenges, or laws in effect in any locations where a Tour, product, or service is operated. You acknowledge you have considered the potential risks, dangers, and challenges and your capabilities and needs, and you expressly assume the risks associated with travel under such conditions.
You must at all times strictly comply with all applicable laws and regulations of all countries and regions. Should you fail to comply with the above or commit any illegal act when on Tour or, if in the opinion of YTE (acting reasonably), your behavior is causing or is likely to cause danger, distress, or material annoyance to others, YTE may terminate your travel arrangements on any product or service immediately at your expense and without any liability on YTE’s part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of the termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.
You are responsible for any costs (including repair, replacement, and cleaning fees) incurred by YTE or YTE’s suppliers for property damage, destruction, or theft caused by you while on a Tour. You agree to immediately report any pre-existing damage to a representative of YTE and staff of the accommodation, transportation service, or facility as soon as possible upon discovery.
You agree to take all prudent measures about your safety while on Tour including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices, and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. Neither YTE nor its Third Party Suppliers (as defined herein) are liable for loss or damages caused by your failure to comply with safety instructions or warnings.
You agree to bring any complaints to YTE as soon as possible to provide YTE with the opportunity to properly address such complaints. You agree to inform your tour leader, another representative of YTE, or YTE’s customer service department directly. YTE assumes no liability for complaints that are not properly brought to the attention of YTE and cannot resolve or attempt to resolve complaints until proper notice is provided. Any complaint made after the completion of a Tour must be received in writing by YTE within 30 days of the last day of travel of the booking in question.
18 – AUTHORITY ON TOUR & CLIENT RESPONSIBILITY
At all times the decision of YTE’s Tour Leader or other designated representative will be final on all matters regarding the safety and well-being of Clients and operational requirements of the Product tour. By traveling with YTE, the Client agrees to abide by the authority of the Tour Leader or designated representative. The Client must at all times strictly comply with all applicable laws and regulations of Egypt and regions visited on the applicable Product tour. If the Client is affected by any condition, medical or otherwise, that might affect the Client’s ability to travel or participate in travel activities, Client’s enjoyment of the Product tour being booked, the ability to travel, or enjoyment of any other Client on the Product tour, or the treatment to be administered to the Client in any emergency, the Client must advise YTE at the time of booking with any other documents reasonably requested by YTE to ensure the health and safety of all Clients who travel with YTE.
Should the Client fail to comply with the above or commit any illegal act when on the tour or, if in the opinion of the Tour Leader (in his/her and/or YTE’s sole discretion), the Client’s behavior is causing or is likely to cause danger, distress or material annoyance to others, YTE may terminate that Client’s travel arrangements on any Product immediately without any liability on YTE’ part and the Client will not be entitled to any refund for unused or missed services or costs incurred resulting from the termination of the travel arrangements, including, without limitation, return travel, accommodations, meals, and/or incidentals.
Clients agree that they are responsible for any costs incurred by YTE, YTE suppliers, or YTE partners, as a result of damage, destruction, theft, or excess cleaning fees related to the Client’s accommodation, transport, or other use of facilities while on Tour. Clients agree to immediately report any pre-existing damage of this kind to staff of the accommodation, transportation service, or facility (as appropriate) and/or a YTE representative as soon as possible upon discovery by the Client.
The client agrees to take all prudent measures about their safety while on any YTE Tour, including, but not limited to, the proper use of safety devices such as seatbelts, harnesses, and helmets, and obeying all posted signs and warnings about Client health and safety. YTE shall not be liable for any failure on the Client’s part to comply with this paragraph.
The Client acknowledges and agrees that YTE is not responsible for providing information or guidance to the Client concerning local customs, weather conditions, specific safety concerns, physical challenges, or laws in effect in any locations where Products are operated, and YTE strongly encourages that Clients locate or make contact with his/her local embassy or consulate in each destination before departure on any YTE Product.
19 -GUARANTEED DEPARTURES
YTE guarantees all scheduled Product tour departures displayed on their website (www.yarotours.com) shall depart as scheduled (subject to reasonably itinerary changes as contemplated elsewhere in these Terms). A departure shall become guaranteed once at least one Client has a confirmed booking upon it (secured, at minimum, via valid payment of a Deposit). This guarantee is not applicable in Force Majeure situations, as herein defined.
20 – CLAIMS AND COMPLAINTS
The client agrees to bring any complaints regarding a Product to YTE as soon as possible to provide YTE with the opportunity to address such complaints properly. The client agrees to inform the Tour Leader or other designated YTE representative at the earliest opportunity, or to the YTE local Office Manager at the nearest location to the applicable Product tour, or YTE’s Customer Service department directly. YTE assumes no liability for complaints that are not properly brought to the attention of Yte with sufficient notice for YTE to resolve or attempt to resolve any Client complaints. Any complaint made after the completion of a Product tour must be received in writing by YTE via its Agents or directly to head office at ‘SUPPORT@yarotours.com’ within 30 days of the end of the tour. The client acknowledges and agrees that YTE will not accept any liability for claims received after this period.
21 – OPTIONAL EXTRAS
Optional Extras (which for this section mean any activity, transportation, meal, or any other product or service not expressly included in the Product description or itinerary, or the price of the Product) do not form part of the tour or Product. The client agrees that any assistance given by YTE’ Tour Leaders or other Yte’ representative in arranging, selecting, or booking, any Optional Extras is purely at the request of the Client, and Yte makes no warranties regarding such information and expressly disclaims any liability whatsoever arising from any Optional Extras or participation thereon by any Client, or any information provided by any Yte representative or Tour Leader regarding any Optional Extras. Accordingly, the Client hereby releases Yte from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to Optional Extras.
22 – PRIVACY POLICY
YTE’s website(s) uses tracking cookies to enhance the user and booking experience. Your use of YTE’s website(s) indicates your assent to such use by YTE’s Privacy Policy. In addition, YTE must collect personal information from Clients to give effect to any booking, deliver the Products, and any collateral services, to assist in evaluating such Products. YTE takes care to safeguard all Client information and protect the privacy of all of our Clients. YTE collects, uses, and discloses only that information reasonably required to enable us to provide the particular product or service that you have requested, to maintain our customer/visitor lists, and/or to respond to your inquiries or feedback, and for other purposes further described in the YTE’s Privacy Policy, which can be accessed any time at https://www.yarotours.com/privacy-policy and is expressly incorporated into these Terms. In particular, YTE may share your information, as necessary, with our third-party suppliers and operators who deliver services or parts of Products to Clients, to enable them to provide such products and services. All such third parties are bound by confidentiality obligations and shall treat all information received from YTE by our Privacy Policy. By submitting any personal information to YTE, Clients indicate their acceptance of the terms of YTE’s Privacy Policy.
